Tuscany WellAway Retreat Terms & Conditions
-Cancellations in writing to contact@wellawayretreats.com for any reason can be made prior to April 1, 2026 for a full refund. Any cancellations for any reason after April 1, 2026 will not be refunded. Failure to attend the retreat for any reason, including missed flights, travel delays, or other disruptions, shall be considered a cancellation and no refund shall be issued. No refunds, credits, or reimbursements will be issued for unused portions of the retreat including late arrival, early departure, voluntary withdrawal, illness, personal emergencies, or travel disruptions outside the control of WellAway Retreats.
-WellAway Retreats is not responsible for travel, domestic or international, by the Customer to and from the retreat itself. The Customer is fully responsible for any delays, cancellations, missed connections, or fees related to flights, trains, or transfers to the venue. Travel insurance is strongly recommended for all participants.
-WellAway Retreats reserves the right to cancel any retreat for any reason whatsoever, including insufficient participation or logistical problems which may impede retreat operations. This includes, but is not limited to, Force Majeure events such as natural disasters, severe weather, epidemics or pandemics, governmental travel restrictions, acts of terrorism, civil unrest, strikes, war, transportation disruptions, or any circumstance beyond WellAway Retreats’ reasonable control. Should cancellation occur, WellAway Retreats will inform the Customer as soon as reasonably possible and issue a full refund of retreat payments made. The refund of all payments made shall release WellAway Retreats from any further liability. WellAway Retreats is not responsible for flights, accommodations outside the retreat booking, or other travel expenses in this case. Travel insurance is strongly recommended.
-The Customer shall keep all fixtures, fittings, furniture, and effects on the property where the retreat is held in clean and good condition and shall pay damages to the property owner for any articles destroyed, damaged, or missing. WellAway Retreats shall under no circumstances be liable for any damage to the property caused by the Customer.
-Accommodation assignments, including shared rooms or roommate pairings where applicable, are made at the discretion of WellAway Retreats. While reasonable efforts will be made to accommodate preferences, specific room locations, views, bedding configurations, or roommate compatibility cannot be guaranteed. Requests for room changes during the retreat may not be possible and shall not constitute grounds for refund or compensation.
-The Customer must ensure they are medically and physically fit and able to participate in retreat activities and use the facilities provided. Participation includes, but is not limited to, yoga, pilates, meditation, excursions, workshops, and wellness programming. Customers with injuries, illnesses, pregnancy, or medical concerns are advised to seek medical advice prior to travel and participation. The Customer must inform WellAway Retreats of any food allergies or intolerances prior to the retreat.
-While WellAway Retreats and its culinary partners make reasonable efforts to accommodate dietary preferences and allergies communicated in advance, meals are prepared in shared kitchens and the absence of cross-contamination cannot be guaranteed. Customers with severe allergies assume responsibility for managing their dietary needs.
-The Customer acknowledges that participation in wellness activities and excursions involves inherent risks and voluntarily assumes all risks associated with participation. WellAway Retreats shall not be liable for injuries, illness, accidents, or health complications arising from participation in retreat activities or use of facilities.
-The Customer is responsible for obtaining appropriate travel and medical insurance coverage, including emergency medical care, evacuation, and repatriation insurance. WellAway Retreats assumes no responsibility for medical treatment, hospitalization, evacuation, or associated costs incurred during or after participation in the retreat.
-Alcohol may be served during portions of the retreat. Customers assume full responsibility for their alcohol consumption and agree to drink responsibly. WellAway Retreats assumes no liability for injury, loss, or damages arising from alcohol consumption.
-WellAway Retreats is not responsible for loss, theft, or damage to personal belongings including luggage, valuables, electronics, or personal effects during travel to or from the retreat or during the retreat itself.
-WellAway Retreats reserves the right to alter the itinerary, including but not limited to changes in accommodation, retreat schedule, excursions, chefs, instructors, wellness practitioners, or workshop content. Where reasonably possible, WellAway Retreats will provide an alternative that is equivalent or of greater value.
-WellAway Retreats is not responsible for the acts, omissions, or services of third-party vendors including but not limited to transportation providers, chefs, wellness practitioners, excursion operators, or venue staff.
-WellAway Retreats reserves the right to remove any Customer from the retreat, without refund, whose behavior is deemed unsafe, disruptive, inappropriate, unlawful, or detrimental to the experience of other participants or staff.
-Customers agree to communicate any concerns or dissatisfaction directly with WellAway Retreats during the retreat to allow reasonable opportunity for resolution.
-The Customer authorizes WellAway Retreats permission to take, edit, publish, distribute, and make use of photographs or video recordings taken during the retreat for legally promotional materials including websites, social media, and email marketing without payment or further consideration. Customers may notify WellAway Retreats in writing prior to the retreat if they wish to opt out of photography or video capture.
-In no event shall WellAway Retreats’ aggregate liability arising out of or related to services performed for you, whether arising out of breach of contract, tort (including negligence), or otherwise, exceed the total amount paid by you to WellAway Retreats. If WellAway Retreats is liable, liability may, pursuant to applicable mandatory regulation, be reduced or lapse in the event of negligence on your behalf that caused or contributed to the damage. Liability is limited to documented direct financial losses only, and WellAway Retreats shall under no circumstances be liable for consequential or indirect losses except as required by mandatory regulation.
-These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California.
-Nothing in these Terms and Conditions shall exclude or limit liability where prohibited by applicable mandatory local laws or regulations in the jurisdiction where the retreat is conducted.
